Terms of Service

These General Terms and Conditions (hereinafter: GTC) contain the rights and obligations of the customer (hereinafter: Buyer) using the electronic commerce services provided by Pihepets Ltd. (registered office: 1089 Bp., Orczy út 12., tax number: 25481819-2-02, hereinafter: Pihepets).

 

1. General Information

1.1 These GTC apply to all sales transactions initiated by the Buyer through online ordering from the Pihepets Internet Store (hereinafter: store).

Purchasing in the store is possible online via the internet by placing the selected product(s) into the cart and completing the ordering process. Orders placed online are recorded by Pihepets customer service, and a confirmation email is always sent to the Buyer. The subsequent purchasing process and applicable conditions for these orders are the same as for orders placed online, therefore these GTC also apply to them.

1.2 Browsing the store is free and possible without registration. Anyone with valid data who accepts the terms of these GTC is entitled to purchase in the store.

1.3 Product data, photos, and descriptions found in the store are the property of Pihepets, therefore mass collection, downloading, or storage is only permitted with prior written consent from Pihepets.

1.4 Within a few minutes after placing an order, our system sends an automatic acknowledgment email to the Buyer confirming receipt of the order; however, this does not constitute a contract. The contract is concluded when Pihepets confirms the order in a second email or notifies the Buyer by phone of the acceptance of the order.

The contract concluded online between the parties in Hungarian language regarding the purchase of goods is considered a written contract, which Pihepets electronically registers and retains for 5 years following its conclusion. The registered contract can also be viewed by the Buyer during this retention period in the store under the “Order Tracking” menu after logging in.

1.5 Order fulfillment time: Depending on stock availability, the actual fulfillment time is 5-7 days; however, the Buyer will be informed about this by email.

1.6 Prices: Prices displayed in the store are valid gross consumer prices. After confirmation, the total payable amount of the order does not change. Despite the utmost care, technical errors may cause incorrect prices significantly different from market prices to appear in our store. In such cases, we will contact you by email before shipping for clarification. Such orders are not considered valid, and Pihepets is not responsible for any damages resulting from them.

2. Registration, Data Protection

2.1 When placing orders, the Buyer may choose to purchase with or without registration. When purchasing without registration, the store only requests the minimally necessary data for order fulfillment (billing data, shipping data). Without registration, no registered buyer is created in the store system, so repeat purchases are not linked to a specific person. The disadvantage of this ordering method for the Buyer is that they cannot use the store services provided exclusively to registered users. When purchasing as a registered user, it is sufficient to provide billing data (name, address, shipping address), as well as a valid email address and phone number necessary for order fulfillment communication. 2.2 The Buyer’s data and order information are stored and protected in a secure database by the store, but are not disclosed to third parties, except when a third party participates in order fulfillment (e.g., courier service). If the Buyer submits a written request to delete their data, the store will delete it from its database. Data usage complies with the privacy policy.

2.3 Forgotten password: Using our password reminder function, you can request your password to be sent to the email address provided at registration. In such cases, we recommend changing your password after logging in.

2.4 Please note that you should treat the password provided at registration confidentially and not share it with unauthorized persons. The store is not responsible for incorrect deliveries or damages resulting from this.

2.5 The store always works with the billing and shipping data provided by the Buyer. Manual data modification is not performed by the store, only based on the Buyer’s phone or email notification. Therefore, it is important that the data is accurate. This guarantees the correct delivery of goods and accurate invoicing. Data can be checked and modified both during order placement and after registration.

3. Browsing the Store

3.1 Our store’s product range includes pet food, litter, and other pet care accessories. Our company strives to provide the maximum selection in every product category. Our assortment is updated daily, expanded, and discontinued products are removed from the store.

3.2 You can select our products by category or use our search function, where entering one or more keywords will list the products available in our offer.

4. Placing an Order

4.1 Products to be ordered must be collected in a virtual cart. Products can be added to the cart by clicking the cart icon or the “add to cart” label. The ordered quantity can be modified in the small white box before clicking the cart.

4.2 Then, on the cart screen, you can decide whether to continue shopping by clicking “continue shopping” or place your order by clicking “Proceed to order”.

4.3 At this point – if you have not done so during browsing – you must register or, if already registered, log in to our store.

4.4 The cart header indicates the number of steps in the ordering process and shows where the Buyer currently is in the purchasing process. Selecting the delivery method is the next step in the cart.

4.5 Payment methods: Direct bank transfer: transfer the exact amount to the specified account number, always including the order number received at the end of the order in the reference. The product will be prepared within 12 hours after receipt of payment and handed over to the courier on the next working day. Note! Orders placed on weekends will be processed earliest on Monday at 10 a.m. Cash on delivery: The order amount is payable to the postal courier or courier service. The cash on delivery fee is 750 HUF. SimplePay card payment: Card payment via the SimplePay website. If the order amount exceeds 30,000 HUF, only SimplePay card payment is available as a payment method. If the order cannot be received due to the Buyer’s fault or omission, only direct bank transfer or SimplePay card payment will be available for the next order.

4.6 Delivery methods, shipping costs:

Personal pickup: We provide the option to pick up products personally on MONDAY-WEDNESDAY-FRIDAY between 12:00-15:00 and TUESDAY-THURSDAY between 7:00-12:30 at 1103 Budapest, Örmény utca 30. Please note that only pickup is possible at the given address; on-site payment is not available, neither by card nor cash, only prepayment or online card payment is accepted.

MPL home delivery: a convenient and simple package receipt option, either at home or another address (e.g., workplace). On the delivery day, the MPL courier will call you to inform you approximately when the package will arrive at the given address. If the first delivery attempt fails, MPL will automatically try again the next working day. The cash on delivery amount can be paid by card with most couriers.

MPL PostaPoints: You can choose from nearly 3000 pickup locations nationwide to find the most convenient MPL PostaPoint for you! You can pick up your ordered packages at post offices or stores during opening hours, and at gas stations typically 24/7. You will be notified by SMS or email about the arrival of the shipment, and the cash on delivery amount can be paid by card or cash.

MPL Parcel Lockers: MPL parcel lockers are available 24/7 every day of the week. They provide a secure and discreet pickup option at 51 locations nationwide. To collect your package, you only need the identifier sent by MPL via SMS or email. If you ordered the package cash on delivery, you can pay by card at the parcel locker.

MPL Post Office Hold delivery: You can choose from nearly 3000 post offices nationwide to find the most convenient one for you. You can pick up your ordered packages at post offices during opening hours. You will be notified by SMS or email about the arrival of the shipment, and the cash on delivery amount can be paid by card or cash.

GLS courier service: a convenient and simple package receipt option, either at home or another address (e.g., workplace). If the first delivery attempt fails, the courier service will make a second, free delivery attempt. The second delivery will take place no later than the fifth working day after the first attempt. No third attempt is possible; after the second failed delivery, the courier service will automatically return the package to the sender.

Delivery within Hungary takes place within 3-7 days following the order.

5. Withdrawal, Warranty, Exchange

Withdrawal: The buyer may withdraw from the contract within 14 days without giving any reason. The buyer must always withdraw from the contract in writing by sending a letter to rendeles@pihepets email. To exercise this right, all of the following conditions must be met: the product(s) have not been used or opened – otherwise, we cannot accept the return of the product(s). However, the Seller may claim compensation for damage resulting from improper use of the product. Pihepets is obliged to refund the product price within 14 days after the package is returned. Refunds are made exclusively by bank transfer. The Buyer bears the costs related to returning the product due to exercising the withdrawal right (return shipping costs). The Buyer is not charged any other costs.

Warranty: When can you exercise your warranty rights? You may assert warranty claims against Pihepets Ltd. in case of 4 defective performances according to the Civil Code. What rights do you have based on warranty claims? You may choose from the following warranty claims: You may request repair or replacement, except if fulfilling your chosen claim is impossible or would cause disproportionate additional costs for the company compared to other claims. If you did not request or could not request repair or replacement, you may request a proportional price reduction or repair the defect yourself or have it repaired by someone else at the company’s expense, or as a last resort, withdraw from the contract. You may switch from one chosen warranty claim to another, but you bear the cost of switching unless it was justified or caused by the company. What is the deadline to assert warranty claims? You must report the defect immediately after discovery, but no later than within two months of discovering the defect. However, please note that you cannot assert warranty rights after the two-year limitation period from contract fulfillment. For used goods, this period is 5, but at most one year. Against whom can you assert warranty claims? You may assert warranty claims against the company. What other conditions apply to asserting warranty rights? Within six months from fulfillment, no other conditions apply to asserting warranty claims beyond reporting the defect if you prove that the product or service was provided by the company. After six months, you must prove that the defect existed at the time of fulfillment.

Product warranty: When can you exercise your product warranty rights? In case of a defect in movable goods (product), you may assert either the rights defined in point 1 or product warranty claims. What rights do you have based on product warranty claims? You may only request repair or replacement of the defective product. When is the product considered defective? The product is defective if it does not meet the quality requirements effective at the time of marketing or does not have the properties described by the manufacturer. What is the deadline to assert product warranty claims? You may assert product warranty claims within two years from the product’s marketing by the manufacturer. After this period, you lose this right. Against whom and under what conditions can you assert product warranty claims? You may only exercise product warranty claims against the manufacturer or distributor of the movable goods. You must prove the defect when asserting product warranty claims. When is the manufacturer (distributor) exempt from product warranty obligations? The manufacturer (distributor) is exempt only if they prove that: – the product was not manufactured or marketed in the course of their business activity, or – the defect was not detectable according to the state of science and technology at the time of marketing, or – the defect results from legal or mandatory official regulations. The manufacturer (distributor) only needs to prove one of these reasons for exemption. Please note that warranty and product warranty claims cannot be asserted simultaneously for the same defect. However, if your product warranty claim is successful, you may assert warranty claims for the replaced or repaired part against the manufacturer.
